This SuperZer Privacy Notice applies to your use of www.SuperZer.com, and any other websites, applications, or services provided, owned, or operated by SuperZer Co. Ltd. (with its affiliates, “SuperZer”) that link to this Privacy Notice (collectively, the “SuperZer Services”). SuperZer values the privacy of users, subscribers, publishers, members, and others who visit and use the SuperZer Services (collectively or individually, “you” or “users”) and wants you to be familiar with how we collect, use, and disclose personal information from and about you. This notice describes our privacy policy. By visiting SuperZer app, setting up your SuperZer account, or using the SuperZer Services, you are accepting the practices described in this Privacy Notice, to the extent permitted by law.

This privacy policy ("Policy") describes how the personally identifiable information ("Personal Information") you may provide on the superzer.com website ("Website"), "SuperZer" mobile application ("Mobile Application") and any of their related products and services (collectively, "Services") is collected, protected and used. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy is a legally binding agreement between you ("User", "you" or "your") and SuperZer Co., Ltd ("SuperZer Co., Ltd", "we", "us" or "our"). By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

For purposes of data protection laws, 18th floor, Three IFC, 10, Gukjegeumyung-ro, Yeongdeungpo-gu, Seoul, Republic of Korea, is the “data controller” of your information collected in connection with the SuperZer Services.

You may share personal information when using the SuperZer Services. One example is when you provide information about yourself as part of the SuperZer account creation process. Another is when you take certain actions on the SuperZer Services that are public or intended to be public in nature, such as when you broadcast content, participate in an offer, post profile information, create an offer, make a call, follow a ZerTag, or subscribe to a user. Given the social nature of some of the SuperZer Services, that information may be collected, used, or disclosed by others who are part of that social interaction. In addition, some features of the SuperZer Services are designed to provide others with information about user activity, such as identifying the user who created a particular offer or the subscription status of ZerTags. We encourage you to be mindful of this when considering your activity on the SuperZer Services.

Storage and access to cookies that are set in connection with the SuperZer Services are governed by the SuperZer Cookie Policy (“Cookie Policy”).

Personal Information SuperZer Collects About You

We obtain information about you through the means discussed below when we provide the SuperZer Services. Please note that we need certain types of information so that we can provide the SuperZer Services to you. If you do not provide us with such information, or ask us to delete it, you may no longer be able to access or use the SuperZer Services.

  • User-provided Information: You may provide a variety of information about yourself to us, such as your name, voice and image (in any content you upload), SuperZer username, email address, postal mailing address, telephone number, credit card number, and billing information when you register for SuperZer Services; upload, purchase, view, or download certain content or products from the SuperZer Services; enter contests or sweepstakes; or otherwise use the features and functionality of the SuperZer Services.

  • Automatically Collected Information: When you access the SuperZer Services or open one of our emails, we automatically record and store certain information about your system by using cookies and other types of technologies. Cookies are small text files containing a string of alphanumeric characters that are sent to your browser. For information about what cookies are, how they work, how SuperZer uses them, and how to remove them, please see our Cookie Policy . Examples of such information we automatically collect include Internet Protocol address (“IP Address”), a unique user ID, device and browser types and identifiers, referring and exit page addresses, software and system type, and information about your usage of SuperZer Services. Examples of how SuperZer uses automatically collected information include to: (a) automatically update the SuperZer application on your system; (b) remember your information so that you will not have to re-enter it during your visit or the next time you access the SuperZer Services; (c) provide customized advertisements, content, and information; (d) monitor the effectiveness of marketing campaigns; (e) monitor and store aggregate site usage metrics such as total number of visitors and pages accessed; and (f) track your entries, submissions, and status in any promotions or other activities.

  • Information from Other Sources: We may obtain additional information from third parties and sources other than the SuperZer Services. For example, we may obtain additional information from advertisers, games or services you use, or social media networks (such as Facebook) for which you have approved our access. When you access the SuperZer Services through social media networks or when you connect the SuperZer Services to social media networks, you are authorizing SuperZer to collect, store, and use such additional information and content in accordance with this Privacy Notice. regarding your use of such services, including about your use of the content you choose to broadcast through the SuperZer Services. We use this information to supplement the information we collect about you in order to provide more relevant, safer experiences for you with the SuperZer Services and improve the SuperZer Services, analytics, and advertising. If we combine or associate information from other sources with information that we collect through the SuperZer Services, we will treat the combined information in accordance with this Privacy Notice.

How SuperZer Uses Personal Information

  • SuperZer uses such information to operate, maintain, enhance, provide, create, and develop all of the features, functionality, and services (new or existing) found on the SuperZer Services; provide security for our websites, products, software, or applications; manage relationships with SuperZer account holders (e.g., Partners, Affiliates), including making or receiving payment; improve users’ experience with SuperZer by providing content recommendations and by delivering content that we hope users will find relevant and interesting, including advertising and marketing messages; allow you to comment on content, and participate in online games, contests, or rewards programs; prevent fraud and abuse; and understand the usage trends of our users.

  • We use your email address and/or telephone number to communicate with you, including to notify you of major SuperZer Services updates, for customer service purposes, or to contact you regarding any content that you have posted to or downloaded from the SuperZer Services. If you want to stop receiving notifications by telephone, reply STOP to any text message from us. Note that we may still send you additional informational or transactional notifications.

  • In certain cases, we have a legal obligation to collect and process your personal information (such as our obligation to share data with tax authorities).

  • We may also ask for your consent to process your personal information for a specific purpose that we communicate to you. When you consent to our processing your personal information for a specified purpose, you may withdraw your consent at any time and we will stop the processing of your data for that purpose.

  • SuperZer will rely on legal grounds to process your personal information to the extent permitted by applicable law, which may include, without limitation:  to honor contractual commitments, to take steps in anticipation of entering into contract, to fulfill legal obligations, your consent, and SuperZer’s legitimate interests.

When SuperZer Discloses Personal Information

We share such information as described below:

  • We disclose such information to service providers working on our behalf, such as, to: provide website hosting, maintenance, and security services; fulfill orders; conduct data analysis and create reports; offer certain functionality; or assist SuperZer in improving the SuperZer Services and creating new services and features. We require that these parties process such information in compliance with this Privacy Notice, we authorize them to use the information only for the purposes for which it is provided to them, and we require them to use reasonable confidentiality measures.

  • SuperZer may make information available to our affiliates (meaning entities controlled by, controlling, or under common control with SuperZer). and its subsidiaries that are either subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.

  • SuperZer may disclose user information if we believe in good faith that such disclosure is necessary to comply with U.S. state and federal laws or other applicable laws around the world (for example, in the country of your residence), or respond to a court order, judicial or other government request, subpoena, or warrant in the manner legally required.

  • SuperZer also reserves the right to disclose information that we believe, in good faith, is appropriate or necessary to protect SuperZer from potential liability or from fraudulent, abusive, or unlawful uses; investigate and defend ourselves against third-party claims, or allegations; protect the security or integrity of the SuperZer Services; or protect the rights, property, or safety of SuperZer, our users, or others.

Other than as set out in this Privacy Notice, you will receive notice when personal information about you might be shared with third parties and you will have an opportunity to choose not to share the information.

Data Subject Rights and Your Choices

SuperZer’s Privacy Choices page describes your privacy options with respect to the SuperZer services, including information about how you may be able to review, update, or delete information that SuperZer may have about you. You may decline to share certain information with SuperZer, in which case SuperZer may not be able to provide to you some of the features and functionality found on the SuperZer Services. If you have created a SuperZer Services account, depending on the service, you may be able to update your profile information and preferences or disable your account by logging in and going to the settings page

For other requests to review, update, delete, or otherwise limit SuperZer’s use of information that you have provided directly to SuperZer, you may contact info@superzer.com In your request, please include your email address, name, address, and telephone number and specify all relevant background. To protect your privacy and security, we may take steps to verify your identity before granting you access or making corrections to your information. You are responsible for maintaining the secrecy of your unique password and account information at all times.

Residents of the European Economic Area (“EEA”) and residents of Brazil can exercise certain data subject rights available to them under applicable data protection laws.  We will comply with requests to exercise these rights in accordance with applicable law. Please note that in some circumstances, we may need to keep processing your information for certain legitimate interests or to comply with a legal obligation.  If these rights apply to you, they may permit you to request that we:

  • Obtain access to or a copy of certain personal information we hold about you.

  • Prevent the processing of your personal information for direct marketing purposes (including any direct marketing processing based on profiling).

  • Update personal information that is out of date or incorrect.

  • Delete certain personal information we hold about you.

  • Restrict the way that we process and disclose specific personal information about you.

  • Transfer your personal information to a third-party provider of services.

  • Revoke consent that you previously provided for the processing of your personal information.

If applicable, you may make a complaint to the data protection supervisory authority in the country where you are based. Alternatively, you may seek a remedy through local courts if you believe your rights have been breached.

Account Closure & Deletion

If you would like to close your account and delete your profile information SuperZer go to Settings > Delete Account. For SuperZer Services, you may update or delete information tied to your account, or close an account, by accessing the “My Account” area of the service or by submitting a help ticket to that service. If you close your account, SuperZer may retain certain information about you for the activities described in this Privacy Notice, or as permitted or required by applicable law.

Third-Party Services and Websites

The SuperZer Services may link to third-party websites or services. The privacy practices of those third parties are not governed by this Privacy Notice. We encourage you to review the privacy policies of these third-party websites and services to understand their practices.

If you connect to a third-party service (such as Facebook, Twitter, or another third-party application) through the SuperZer Services or otherwise link your SuperZer account with a third-party service, you are requesting and authorizing us to share or grant access to information on your behalf (such as your username, the fact that your connection originated from the SuperZer Services, and other relevant usage and diagnostic information) with such third party. We may also send information about the content you watch or your activities on the SuperZer Services to such third parties. For example, we may make information available to app developers, game developers, and game publishers to facilitate purchases and awards of digital goods, such as games and in-game items.

Advertisers and Analytics Providers

SuperZer may use third-party Web analytics services in connection with the SuperZer Services. These service providers use a variety of tracking technologies such as cookies to analyze how users use the SuperZer Services. The information collected (described above in “Automatically Collected Information”) may be shared with or collected directly by these services and processed to evaluate your use of the SuperZer Services.

SuperZer may also work with third-party ad networks, advertisers, and advertising analytics providers to target (and measure the performance of) ads to you both on and off the SuperZer Services. We may share with these third parties (or they may directly collect) data such as cookie and mobile ad identifiers in order to engage in advertising activity (including to understand how you respond to advertisements and to serve relevant ads). SuperZer also works with third parties to serve ads to you off SuperZer’s Services. When we do so, we may share information such as your email address or resettable device identifier for that advertising partner to “match” to other information that may have about you.

Advertisers on SuperZer, or representatives or service providers working on their behalf (“SuperZer Advertisers”), sometimes use technology to serve ads that appear on our services directly to your device.  They automatically receive certain data, such as your IP address, when this happens. They may also use cookies (or similar technologies) to measure the effectiveness of their ads and to personalize ad content. This Privacy Notice does not apply to, and we cannot control the tracking technologies and activities of SuperZer Advertisers and you should consult their respective privacy policies. Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. We are committed to providing you with meaningful choices about the information collected on our website for third-party purposes, and that is why we provide the Network Advertising Initiative, Your Online Choices and the Digital Advertising Alliance opt-out links above. However, SuperZer does not recognize or respond to browser-initiated DNT signals.

Data Security

SuperZer uses a variety of managerial, technical, and physical measures to protect the integrity and security of your information. These measures may vary based on the sensitivity of your information. However, no security precautions or systems can be completely secure. We cannot ensure or warrant the security of any information you transmit to SuperZer, and you do so at your own risk. We cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Retention of Your Information

SuperZer maintains data related to your usage of SuperZer for as long as it is required in order to fulfill the relevant purposes described in this Privacy Notice, as may be required (or permitted) by law such as for tax and accounting purposes, or as otherwise communicated to you. Once you have asked us to close your account and delete your profile information, we will delete all information that we are not required or permitted to retain by law.

Merger or Sale

In the event that SuperZer, or some or all assets related to the SuperZer Services are acquired by or merged with a third-party entity or in connection with a contemplated change of ownership transaction, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from users as part of that merger, acquisition, sale, or other change of control event, including in the course of diligence.

International Data Transfers

Information collected by SuperZer may be stored and processed in your region, in the United States (for instance in our major data centers), or in any other country where SuperZer or its affiliates, subsidiaries, partners, or service providers are located or maintain facilities.  If we provide any information about you to any such entities, we will take appropriate measures to ensure such companies protect your information adequately in accordance with this Privacy Notice and applicable law.

Changes and Updates to This Privacy Notice

SuperZer reserves the right to change, modify, add, or remove portions of this Privacy Notice at any time (for example to reflect updates to the SuperZer Services or to reflect changes in the law). Please check this Privacy Notice periodically for those changes. Your continued use of the SuperZer Services after the posting of changes constitutes your binding acceptance of such changes.

We will not materially change our policies and practices to make them less protective of personal information collected in the past under a prior version of the Privacy Notice without the consent of affected individuals

Republic of Korea Privacy Notice

The information below pertains to users in the Republic of Korea.

Retention of Personal Information

Your personal information will be retained and used for the duration of your business relationship with SuperZer and as long as thereafter as necessary for SuperZer’s legal and regulatory obligations, dispute resolution, community and site safety and security, and contract enforcement.

SuperZer will delete your personal information in accordance with SuperZer’s data retention policies and applicable laws. After you close your account, SuperZer will delete your personal information in a timely manner, provided however, if any personal information is required or permitted to be retained under applicable law or as necessary for SuperZer’s legal and regulatory obligations, dispute resolution, community and site safety and security, and contract enforcement, such information will be retained for the period required for such purposes.

Deletion of Personal Information 

When deleting personal information, SuperZer will take standard commercially reasonable measures to make the personal information irrecoverable or irreproducible. The specific manner of deletion will depend on the information being deleted and the type of SuperZer Services that you used. Electronic documents or files containing personal information will be deleted using a technical method that makes recovery or retrieval of such information practically impossible or renders the data no longer personally identifiable. Non-electronic documents or files containing personal information will be shredded, incinerated or both.

Automatic collection of information

When you open the Website or use the Mobile Application, our servers automatically record information that your browser or device sends. This data may include information such as your device's IP address and location, browser and device name and version, operating system type and version, language preferences, the webpage you were visiting before you came to the Services, pages of the Services that you visit, the time spent on those pages, information you search for on the Services, access times and dates, and other statistics.

Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage and traffic of the Services. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.

Collection of personal information

You can access and use the Services without telling us who you are or revealing any information by which someone could identify you as a specific, identifiable individual. If, however, you wish to use some of the features on the Services, you may be asked to provide certain Personal Information (for example, your name and e-mail address). We receive and store any information you knowingly provide to us when you create an account, publish content, make a purchase, or fill any online forms on the Services. When required, this information may include the following:

  • Personal details such as name, country of residence, etc.

  • Contact information such as email address, address, etc.

  • Account details such as user name, unique user ID, password, etc.

  • Proof of identity such as photocopy of a government ID.

  • Payment information such as credit card details, bank details, etc.

  • Geolocation data such as latitude and longitude.

  • Certain features on the mobile device such as contacts, calendar, gallery, etc.

  • Information about other individuals such as your family members, friends, etc.

  • Any other materials you willingly submit to us such as articles, images, feedback, etc.

Some of the information we collect is directly from you via the Services. However, we may also collect Personal Information about you from other sources such as public databases and our joint marketing partners. You can choose not to provide us with your Personal Information, but then you may not be able to take advantage of some of the features on the Services. Users who are uncertain about what information is mandatory are welcome to contact us.

Use and processing of collected information

In order to make the Services available to you, or to meet a legal obligation, we need to collect and use certain Personal Information. If you do not provide the information that we request, we may not be able to provide you with the requested products or services. Any of the information we collect from you may be used for the following purposes:

  • Create and manage user accounts

  • Fulfill and manage orders

  • Deliver products or services

  • Improve products and services

  • Send administrative information

  • Send marketing and promotional communications

  • Respond to inquiries and offer support

  • Request user feedback

  • Improve user experience

  • Deliver targeted advertising

  • Administer prize draws and competitions

  • Enforce terms and conditions and policies

Processing your Personal Information depends on how you interact with the Services, where you are located in the world and if one of the following applies: (i) you have given your consent for one or more specific purposes; this, however, does not apply, whenever the processing of Personal Information is subject to California Consumer Privacy Act or European data protection law; (ii) provision of information is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof; (iii) processing is necessary for compliance with a legal obligation to which you are subject; (iv) processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us; (v) processing is necessary for the purposes of the legitimate interests pursued by us or by a third party.

Note that under some legislation we may be allowed to process information until you object to such processing (by opting out), without having to rely on consent or any other of the following legal bases below. In any case, we will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Billing and payments

In case of services requiring payment, we request credit card or other payment account information, which will be used solely for processing payments. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. Where necessary for processing future payments and subject to your prior consent, your financial information will be stored in encrypted form on secure servers of our reputed payment gateway service provider who is beholden to treating your Personal Information in accordance with this Policy. All direct payment gateways adhere to the latest security standards as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. Sensitive and private data exchange happens over a SSL secured communication channel and is encrypted and protected with digital signatures, and the Services are also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users. Scans for malware are performed on a regular basis for additional security and protection.

Managing information

You are able to delete certain Personal Information we have about you. The Personal Information you can delete may change as the Services change. When you delete Personal Information, however, we may maintain a copy of the unrevised Personal Information in our records for the duration necessary to comply with our obligations to our affiliates and partners, and for the purposes described below. If you would like to delete your Personal Information or permanently delete your account, you can do so on the settings page of your account on the Services or simply by contacting us.

Disclosure of information

Depending on the requested Services or as necessary to complete any transaction or provide any service you have requested, we may share your information with your consent with our trusted third parties that work with us, any other affiliates and subsidiaries we rely upon to assist in the operation of the Services available to you. We do not share Personal Information with unaffiliated third parties. These service providers are not authorized to use or disclose your information except as necessary to perform services on our behalf or comply with legal requirements. We may share your Personal Information for these purposes only with third parties whose privacy policies are consistent with ours or who agree to abide by our policies with respect to Personal Information. These third parties are given Personal Information they need only in order to perform their designated functions, and we do not authorize them to use or disclose Personal Information for their own marketing or other purposes.

In the event we go through a business transition, such as a merger or acquisition by another company, or sale of all or a portion of its assets, your user account, and Personal Information will likely be among the assets transferred.

Retention of information

We will retain and use your Personal Information for the period necessary to comply with our legal obligations, resolve disputes, and enforce our agreements unless a longer retention period is required or permitted by law. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the retention period.

Transfer of information

Depending on your location, data transfers may involve transferring and storing your information in a country other than your own. You are entitled to learn about the legal basis of information transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by us to safeguard your information. The rights of users

You may exercise certain rights regarding your information processed by us. In particular, you have the right to do the following: (i) you have the right to withdraw consent where you have previously given your consent to the processing of your information; (ii) you have the right to object to the processing of your information if the processing is carried out on a legal basis other than consent; (iii) you have the right to learn if information is being processed by us, obtain disclosure regarding certain aspects of the processing and obtain a copy of the information undergoing processing; (iv) you have the right to verify the accuracy of your information and ask for it to be updated or corrected; (v) you have the right, under certain circumstances, to restrict the processing of your information, in which case, we will not process your information for any purpose other than storing it; (vi) you have the right, under certain circumstances, to obtain the erasure of your Personal Information from us; (vii) you have the right to receive your information in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that your information is processed by automated means and that the processing is based on your consent, on a contract which you are part of or on pre-contractual obligations thereof.

The right to object to processing

Where Personal Information is processed for the public interest, in the exercise of an official authority vested in us or for the purposes of the legitimate interests pursued by us, you may object to such processing by providing a ground related to your particular situation to justify the objection. You must know that, however, should your Personal Information be processed for direct marketing purposes, you can object to that processing at any time without providing any justification. Data protection rights under GDPR

If you are a resident of the European Economic Area (EEA), you have certain data protection rights and SuperZer Co., Ltd aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Information. If you wish to be informed what Personal Information we hold about you and if you want it to be removed from our systems, please contact us. In certain circumstances, you have the following data protection rights:

  • You have the right to request access to your Personal Information that we store and have the ability to access your Personal Information.

  • You have the right to request that we correct any Personal Information you believe is inaccurate. You also have the right to request us to complete the Personal Information you believe is incomplete.

  • You have the right to request the erase your Personal Information under certain conditions of this Policy.

  • You have the right to object to our processing of your Personal Information.

  • You have the right to seek restrictions on the processing of your Personal Information. When you restrict the processing of your Personal Information, we may store it but will not process it further.

  • You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.

  • You also have the right to withdraw your consent at any time where SuperZer Co., Ltd relied on your consent to process your Personal Information.

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority in the European Economic Area (EEA).

California privacy rights

In addition to the rights as explained in this Policy, California residents who provide Personal Information (as defined in the statute) to obtain products or services for personal, family, or household use are entitled to request and obtain from us, once a calendar year, information about the Personal Information we shared, if any, with other businesses for marketing uses. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which we shared such personal information for the immediate prior calendar year (e.g., requests made in the current year will receive information about the prior year). How to exercise these rights

Any requests to exercise your rights can be directed to SuperZer Co., Ltd through the contact details provided in this document. Please note that we may ask you to verify your identity before responding to such requests. Your request must provide sufficient information that allows us to verify that you are the person you are claiming to be or that you are the authorized representative of such person. You must include sufficient details to allow us to properly understand the request and respond to it. We cannot respond to your request or provide you with Personal Information unless we first verify your identity or authority to make such a request and confirm that the Personal Information relates to you.

Privacy of children

We do not knowingly collect any Personal Information from children under the age of 13. If you are under the age of 13, please do not submit any Personal Information through the Services.
